Privacy policy – general information

  1. The administrator of your personal data (hereinafter referred to as the “Administrator”) is Awesome Bytes Limited Liability Company with its registered office in Łódź 90-625, Żeromskiego 53 Street, entered into the Register of Businesses of the National Court Register kept by the District Court for the city of Łódź, 20th Commercial Division, under National Court Register Number 0000767584, Tax Identification Number 7272834964, National Business Registry Number 382360515.
  2. Processing of your personal data is based on Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119/1, hereinafter: “GDPR”), which provides that the processing of personal data is permitted by law if it is necessary for the performance of an agreement to which the data subject is party or to take action at the request of the data subject prior to entering into the agreement. The basis for processing of your personal data, to the extent that the processing is necessary for the fulfilment of legal obligation of the administrator is at the same time Article 6(1)(c) of the GDPR and to the extent that the processing is necessary for the purposes of legitimate interests pursued by the administrator or by a third party is Article 6(1)(f) of the GDPR.
  3. The above does not preclude the processing of your personal data, to the extent exceeding that indicated above, after you have given your consent for processing on the basis of Article 6(1)(a) of the aforementioned Regulation.
  4. Awesome Bytes Limited Liability Company with its registered office in Łódź processes information obtained directly from customers and from public and generally available sources (including the Internet), creating a database.
  5. In accordance with the applicable regulations on personal data protection, in order to ensure proper protection of personal data, the Administrator under the general principles of personal data processing shall ensure that the rights of data subjects, including the right to privacy protection, are respected and observed.
  6. The Administrator stores personal data which are necessary to provide the services or activities to which the User has given consent or which arise from a legal obligation.

Privacy policy – specific information

  1. Personal data are processed for the purpose:
    • in accordance with the agreement to provide products and services as well as to pursue Awesome Bytes’ legitimate interest in the direct marketing of Awesome Bytes products and services;
    • in accordance with the consent given, whereby consent may be withdrawn at any time, but this will not affect processing carried out before withdrawal;
    • legitimate interest of the administrator in the need to maintain a business relationship, subject to any objection to that processing;
    • fulfilment of the legal obligation imposed on the administrator in relation to the provisions of Accounting Act of 29 September 1994 (Journal of Laws of 1994, No. 121, item 591);
    • compliance with the legal obligation imposed on the administrator in relation to the provisions of the Labour Code of 26 June 1974. (i.e. Journal of Laws of 2018, item 108 as  amended).
  2. The provision of personal data is voluntary, each data subject has the right to object to the data processing by the administrator, but the refusal to provide them may result in preventing the conclusion of an agreement.
  3. Personal data is obtained through forms posted on the website, direct contact, e-mail, telephone or through other external applications such as Messenger.
  4. All data subject has at any time the right to access the content of own personal data, to correct them, to demand temporary or permanent suspension of their processing, deletion or restriction of processing, the right to withdraw consent to their processing, the right to object to the processing, the right to transfer the data, and the right to lodge a complaint with the supervisory body, i.e. the President of the Office for Personal Data Protection. In order to exercise the above rights, it is necessary to contact the Administrator.
  5. Personal data will be used only for the purposes specified in the Privacy Policy, unless the User agrees to the processing of data for other purposes or if the use of information is required by law.
  6. Personal data will be processed until the statute of limitations for claims arising from or related to the conclusion of an agreement or until the expiry of data storage obligations under the law.
  7. The processed data may be made available to other entities operating in the business environment, related or cooperating with Awesome Bytes Ltd., for the purposes related to the implementation of business processes (in particular for the performance and conclusion of agreements, claims handling).
  8. Personal data is processed by persons exclusively authorized or processing persons with whom entrustment agreements have been signed.
  9. Personal data may be transferred to recipients in third countries, i.e. outside the European Economic Area (EEA), but this shall be done with adequate and appropriate protections. At the same time, we would like to inform that your personal data may be processed by Google LLC, Apple Inc. and Microsoft Corporation, in accordance with Article 45 of the GDPR, for the use of computer software in the Company.
  10. The Administrator makes every effort to ensure that all physical, technical and organizational measures are taken to protect your personal data against accidental or intentional destruction, accidental loss, modification, unauthorized disclosure, use or access, in accordance with all applicable laws. To ensure the security of all users’ personal information, all connections between your computer and the Company’s server are encrypted using SSL (SecureSocketLayer). Databases used by Awesome Bytes Ltd. are additionally protected against access by third parties.
  11. Personal data are processed electronically and manually, in accordance with the methods and procedures related to the purposes of processing referred to above.
  12. Legitimate interests pursued by the Company consists in conducting on the premises of the Company’s video monitoring related to ensuring security and offering (marketing) services, including the provision of comprehensive business information on the services offered by the Company.

RULES ON THE PROCESSING OF PERSONAL DATA:

The indicated rules on the processing of personal data, compliance with which is supervised by the Administrator, are the following:

  1. collected personal data are processed in accordance with the law, in a reliable and transparent manner;
  2. the personal data are used for an established, specific and limited purpose;
  3. minimizing data which must be appropriate for the established purpose;
  4. correctness of the personal data collected, with the possibility to update it if necessary;
  5. limited storage time;
  6. data integrity and confidentiality, which ensure adequate protection of personal data collected and processed.

LEGAL GROUNDS FOR PROCESSING PERSONAL DATA:

In the light of the above, we would like to inform you that the processing of personal data is in accordance with the law if one of the conditions indicated in Article 6(1)(a-c) and (f) of the GDPR is fulfilled, i.e.

  1. the data subject has consented to the processing of personal data for one or morevspecified purposes;
  2. processing is necessary for the performance of an agreement to which the data subject is a party or to take action at the request of the data subject before concluding the agreement;
  3. processing is necessary for compliance with a legal obligation on the administrator;
  4. processing is necessary for the purposes of legitimate interests pursued by the administrator or by a third party.

FOR WHAT PURPOSE AND ON WHAT BASIS PERSONAL DATA ARE PROCESSED

Legally justified interests pursued by Awesome Bytes Ltd. consist in hiring programmers and offering its customers products and services of IT outsourcing and comprehensive IT services in the Salesforce platform.

IN RELATION TO THE APPLICANTS – POTENTIAL EMPLOYEES:

Processing of personal data is carried out in order to start the recruitment process and create a database of potential employees.

In addition, in order to provide comprehensive business information services within the services offered by the Company, but not requiring the creation of an account, personal data concerning the activity on the awesomebytes.pl portal, including data concerning viewed job offers, session data, device and operating system, browser, location and unique ID. If you use external applications such as Messenger, your Facebook profile data and any data provided in messages sent through Messenger are also processed.

After sending the application, the Administrator processes the personal data you have provided voluntarily in the application form on www.awesomebytes.pl or, in the case of an external application, the data provided by this service.

In the scope of direct contact, the data concerning your image is also processed in order to provide information to the relevant entities in case of an event concerning you in relation to the security monitoring of the Company.

In addition, the law requires the processing of your personal data for tax and accounting purposes, as well as for the purpose of pursuing claims.

We also process personal data obtained from you in the course of providing our services and performing the agreement.

At the same time, please note that you were not and are not obliged to provide us with any data, and that providing such data is not a statutory obligation. Failure to provide your data would not and will not result in any negative consequences for you except the inability to ACCESS to the recruitment process and conclude a specific agreement with the Company. The Administrator processes your personal data also to the extent that they are made available by public sources.

IN RELATION TO PERSONS INTERESTED IN THE COMPANY’S SERVICES – POTENTIAL CLIENTS:

The processing of personal data is carried out in order to sell products, provide IT outsourcing and comprehensive IT services in the Salesforce platform, as well as create a customer database.

In addition, in order to provide comprehensive business information services within the scope of services offered by the Company, the Administrator processes personal data concerning activity on awesomebytes.pl, including data concerning the offers being viewed, session data, device and operating system, browser, location and unique ID. In case of using external applications such as Messenger, the data provided in Facebook profile and any data provided in messages sent via Messenger application are also processed.

The Administrator processes the personal data you have provided voluntarily in direct contact, via awesomebytes.pl or in case of any other external service registering data provided by this service.

Failure to provide your data would not and will not result in any negative consequences for you except the impossibility of the Company to provide you with services or present an offer and conclude a specific agreement with the Company. The Administrator processes your personal data also to the extent that they are made available by public sources.

SCOPE OF DATA COLLECTION

The Company collects your data to the extent necessary to achieve the objectives indicated above. These include, in particular, name, surname, address, phone contact and e-mail address.

DURATION OF PERSONAL DATA PROCESSING

Your personal data will be processed by Awesome Bytes Sp. z o.o. for the duration of the provision of services by the Company and the term of the agreement concluded with you, as well as after its termination for the purpose of pursuing claims under the concluded agreement and the performance of obligations arising from the provisions of law, in particular tax and accounting law, but not beyond the period of the statute of limitations of claims arising from the concluded agreement or the expiry of the deadlines indicated by the relevant legislation.

After this period, your data may be stored by the Company if you have agreed to leave your personal data in the database.

Your data will be stored until your consent is withdrawn, in which case it will be removed within 1 month after withdrawal.

With regard to offering (marketing) services, including the provision of comprehensive business information on the services offered by the Company, your data will be processed until you object to such processing or withdraw your consent.

In case of failure to conclude an agreement, the Administrator stores your data for a period not longer than 12 months.

DATA SUBJECTS’ RIGHTS:

In relation to the processing of your personal data, you have the right to request the rectification (correction) and completion, removal, restriction of processing, transfer, access to the personal data provided to the Company.

In addition, you have the right to withdraw your consent to the processing of personal data at any time without affecting the processing that was carried out on the basis of your consent prior to its withdrawal. You also have the right to lodge a complaint with the supervisory authority, i.e. the President of the Office for the Protection of Personal Data, Stawki 2 Street, 00-193 Warsaw.

You also have the right to object if there are reasons related to your specific situation and the processing of your data is based on necessity for the purposes of our so-called legitimate interests or at any time against the processing of your data for the purposes of direct marketing, including profiling, and once you have raised this objection we will no longer be allowed to process your data for such purposes.

WHO MAY BE THE RECIPIENT OF YOUR PERSONAL DATA:

The main recipient of your personal data is Awesome Bytes Sp. z o.o.

The recipients of your personal data are also cooperating entities, including so-called Processors in relation to the performance of activities on behalf of the Company, on its behalf, courier companies and postal services, accounting office, law firms that may conduct proceedings on behalf of the Company and entities providing media necessary to provide the Company’s services. The recipients of your personal data may also be courts and other authorities in case of pursuing claims resulting from agreements concluded with the Company.

Your personal data may be transferred to recipients in third countries, i.e. outside the European Economic Area (EEA), but this shall be done with adequate and appropriate protections. At the same time, we would like to inform you that your personal data may be processed by Google LLC, Apple INC. and Microsoft Corporation, in accordance with Article 45 of the GDPR, for the use of computer software in the Company.

PROFILING AND AUTOMATED DECISIONS CONCERNING PERSONAL DATA:

The Company may make automated decisions based on your personal information, including profiling as referred to in Article 22(1) and (4) of the GDPR. Profiling carried out by the Administrator consists in particular in assigning and matching personal data given to the Company, including data from the Resume and data concerning activity in the portal, recorded and stored by means of cookies. The above information is used to create a user profile in the database, which is then used to present the best possible offer to such a user.
