Is the employer obliged to simplify the improvement of employee qualifications?

In Awesome Bytes, we care about the improvement of employee qualifications and regularly give them opportunities to get new certificates. Anyone can learn, and of course the cost of training is borne by the company.


Regulations for improvement of employee qualifications contained in the Labour Code provide for many privileges for employees who improve their knowledge and qualifications. The scope of the privileges depends on whether the employee is training at the initiative of the employer or with his consent, or whether he does it on his own. Raising professional qualifications is very important to us. In Awesome, we focus on our activity, we indicate paths and specific training that an employee can complete. The Salesforce platform gives you the opportunity to learn, exams and get certificates in a clear way for everyone.

The consent of the employer to finance expenses related to the employee improvement of professional qualifications is not the only way for the employer to fulfil the obligation imposed by the labour law. At Awesome Bytes, we create working conditions beneficial to educating employees, e.g. through training during working hours. However, it should be remembered that the labour law require equal treatment of all employees, also in terms of the availability of professional development:

Art. 18 3a. § 1. Employees should be treated equally in terms of establishing and terminating employment, terms of employment, promotion and access to training in order to improve professional qualifications, in particular regardless of their sex, age, disability, race, religion nationality, political beliefs, trade union membership, ethnicity, religion, sexual orientation, employment for a fixed or indefinite period, full-time or part-time employment. § 2. Equal treatment in employment means non-discrimination in any way, directly or indirectly, for the reasons specified in § 1. § 3. Direct discrimination exists when an employee for one or more reasons specified in § 1 was, is or could be treated in a comparable situation less favourably than other employees. § 4 Indirect discrimination exists when, as a result of an apparently neutral decision, criterion applied or action taken, there are or could occur unfavourable disproportions or a particularly unfavourable situation with regard to the establishment and termination of an employment relationship, employment, promotion and access to training in order to improve professional qualifications for all or a significant number of employees belonging to the group distinguished due to one or more reasons specified in § 1, unless the provision, criterion or action is objectively justified due to compliance with law c el to be achieved and the means of achieving it are appropriate and necessary.

The rights of an employee who raises his professional qualifications depend on whether it is done with the consent or on the initiative of the employer, or without the initiative / consent of the employer.

 

Why improvement of employee qualifications is important?


We have two sides of the coin here, an employer for whom an educated employee is an obvious benefit that translates into the company’s profit and an employee who, thanks to learning, has the opportunity for personal development and increases his value. More importantly, each success and passing the exam gives us a sense of how valuable we are. We like to think about ourselves well, and learning after passing an exam gives us a big boost of energy, which when translated into work makes us a trustworthy partner in the eyes of the employer.
